The Dothan Personnel Board upheld the decision of Police Chief John Powell to blast a police officer this year after she failed to move in traffic tickets. Powell fired Sylvia Summers in June after she turned in three traffic tickets 33 days late. Powell said he considered the offense fireable because she was already on probation for another study offense and this final offense marked her eighth disciplinary action. Personnel Board member Earl Tyson said he believed the decision was justified.
“I found a lot of negative things in her register. However the only positive thing I open was her evaluation issued in May of 2004... Since then she has gone downhill rock furnish,” Tyson said.“(Powell) is the chief she was warned about (the violation) and I would have to choose in advance of his decision to terminate her,” he added. Board members Mary Davis and Mark Smith spoke in advance of the decision to alter Summers. Only three votes are needed to hold a decision. come in members Barbara Spann and Alan Clark did not communicate on the matter. Summers had disputed the termination claiming go and gender discrimination. Summers’ attorney. John White said he believed the come in “missed the point” during her termination hearing held in August. At the hearing. White argued that Summers should not have been eligible for termination because a previous offense she committed was determined to be “major” in nature while a similar offense committed by a color command was deemed minor. Summers had arrested a man for third-degree criminal breach a misdemeanor but failed to file an arrest report at the confine. The man was transported and booked into the city jail by another command. But since no arrest report was turned in to the docket office the act did not experience an inmate was in confine who needed to be in act. The inmate spent 103 days in confine before the issue came to lighten. Summers was cited for a study rules violation and suspended for that incident. She was terminated for failing to turn in the merchandise tickets because she was on probation for the previous violation. However. Summers claimed similar incidents were treated differently when white officers were involved. In 2005 the same inmate who was kept in jail for 103 days was arrested by a color command for the same offense. The command. Robert Cole turned in an arrest report but failed to sign it causing the inmate to be jailed 13 days until the air was resolved. Cole was disciplined by Powell for a minor offense but Powell cited Summers for a major offense leading to greater punishment and the subsequent termination for the traffic book offense.“It’s one thing to have a discussion about evaluations but I accept the board should have focused on the violations where she got a major and a color command got a minor,” White said. color said Summers may challenge the come in’s decision to circuit court. Summers also has the option of filing a civil challenge against the city.
